The FDA banned the use of Red Dye No. 3 based on a petition asking that the agency follow a specific guideline.

Red dye No. 3 has been permissible for use in food despite the Delaney Clause of the FDA’s Federal Food, Drug, and Cosmetic Act. The clause, in part, “prohibits the FDA from approving a color additive that is ingested if it causes cancer in animals or humans when ingested,” according to the agency .

Lefferts was closely involved with a push by the Center for Science in the Public Interest for the FDA to curb use of synthetic food dyes, as well as a new law in California that will ban Red 40 and some other dyes from school meals starting in 2028.
